A Breach of Lease contract or notice is issued to the tenant when they have breached the original lease agreement that they signed, or one of the rules stated within the lease agreement.
Usually, the landlord will issue the breach of lease agreement contract to the tenant to notify them that they have breached the lease in some manner. This notice will provide the tenant with information as to how they have breached the lease, and notify the tenant that they need to remedy the matter.
There are many, many ways that your tenant could breach their lease agreement. With our Breach of Lease Agreement Template above we allow you to state the specific reasons as to how the tenant breached their lease contract.
When you issue a breach of lease notice to the tenant, it is recommended that you add proof of delivery because you may have to start legal proceedings or issue an eviction notice if the tenant does not resolve the matter – and you don’t want your tenant to state that they never received the breach of lease notice, as that could hold matters up.
Whether it is a residential lease or a commercial lease agreement that the tenant has breached – the information within the breach of lease contract notice is the same. You should of course, list both the landlords name and address, the tenants name and address as well as the property name and address for complete clarity.
You may want to attach a copy of the initial lease agreement. If you previously generated your lease agreement via SimpleForms.org it should still be available in your account for easy printing. If you have any issues you can contact us. If you choose “yes” you will be attaching a copy of the lease agreement, then there will be a sentence within the completed breach of lease notice stating this.
The landlord should specify the date that the breach of lease was committed, and the days notice being given for the tenant to take action against this breach of lease. You should always provide specific reasons with “no wiggle room” in regard to the exact breach of agreement. As there are so many possibilities when it comes to a breach of lease we have left that one open-ended for you, and you can state for yourself the exact issue(s).
We also offer the option of proof of service in case you want the tenant to confirm that they have received the breach of lease notice – something that is usually always a good idea. If you want to get a witness to sign your breach of lease, you can add multiple witnesses and we offer that option for you.
Finally, if you wish to see a Breach of Lease blank template then you can click to build your agreement, and it will create an empty breach of lease form for you, offering you a sample of what your full form will look like.
Our Breach of Lease Agreement is the same for commercial lease breach or residential lease breach as neither ever differ in terms of the content within the breach of lease notice.
Once you have created your breach of lease agreement, it will be provided for you in three separate formats. You can either choose to access the breach of lease via your web browser for printing, via a Word Processor software such as Microsoft Word, Wordpad or OpenOffice – it’s an RTF file, so it is compatible with practically every Word Processing software – even Lotus!
You can also access the Breach of Lease in PDF format, which works with Adobe Acrobat.
