What is a Security Agreement Contract?

If two parties have created a promissory note or loan agreement and have listed collateral within that contract, then they may wish to also create a security agreement contract.

This contract is in addition to the promissory note, and shall protect the collateral mentioned in the promissory note, as well as provide specific details about the collateral.

As you can see above – the security agreement contract is very easy to fill in – we’ve made it as easy as possible for you. To begin with, fill in the basic information that is within the promissory note which is the name and address of both the lender, and the borrower.

Also in regard to the initial promissory note, please provide the date that the initial note was created, as well as the amount borrowed. It’s recommended you also attach the promissory note to the security contract agreement, and if you wish to do that then you simply click “Yes” in the field above.

The important information is of course, the Collateral. The security agreement is stating that the Debtor is granting the loaner to the secured interest in the collateral, and that the loaner may take the collateral if there is issues with the repayment structure set forth in the promissory note agreement.

You will need to provide specific details about the collateral. If there are currently no claims or liens against the collateral then it must be noted within the agreement, and also noted that the debtor shall keep the collateral free from any lien, as well as in proper repair. The debtor must maintain the collateral, if applicable, and ensure no problems occur with the collateral.

You shall want to state where the collateral will be kept during this period – be it at the lenders address, debtors address or at a third-party address.
