If a tenant of a property wishes to sublease their premises – even if it is written within the lease agreement that they are allowed to – they must submit a sublease consent form to their current landlord to get their signature on it, to approve of the sublease.
On a side note – the person or persons subleasing the property must also abide by all of the rules covered in the original lease agreement signed between the master landlord, and the person(s) who are subleasing the property.
A sublease consent form can be a lot more complicated than you would think. How does a sublease work? Well, it’s simple, really. A sublease contract allows the original tenant of a rental property to become a sublandlord and rent out some or all of the property that they are renting. The sublandlords tenant becomes a subtenant. In order to make this sort of agreement, the landlord/owner of the property must sign a landlord’s consent to sublease form.
The agreement states that the original tenant will maintain all of the obligations that they agreed with the landlord in the original lease while also no being liable for damages or less violations committed by the subtenant. In many cases, the sublandlord will collect the rent from their subtenant before passing it on to the landlord.
Sublandlords will often look to set up a sublease agreement with their subtenant. The way that a sublease agreement works is that it lays out the responsibilities and the expectation for all of the parties in the sublease: the landlord, the sublandlord, and the subtenant. The sublease agreement can be a great way to prevent any misunderstandings about payment, maintenance, or liabilities.
In general, tenants cannot sublease without the written consent of their landlord prior to subleasing. Many lease agreements include clauses regarding subleases that explicitly state the policy on subleasing. This does not mean that they can never sublease, only that they need to get a subleasing agreement and a consent to sublease form from the landlord. If a tenant were to sublease without the landlord’s permission, they could be in violation of their lease and face eviction.
